Navigating the Quagmire of Global Data Protection Laws: An Interjurisdictional Analysis of Compliance Challenges for Multinational Corporations

Abstract

Data protection has emerged as a pressing challenge for multinational corporations (MNCs) operating in diverse legal landscapes. This article examines compliance hurdles faced by MNCs in adhering to various global data protection laws, particularly focusing on the General Data Protection Regulation (GDPR) in the European Union and the California Consumer Privacy Act (CCPA) in the United States. Utilizing a mixed-methods approach, we conducted a qualitative analysis of legal texts supplemented by quantitative surveys of compliance officers across 150 corporations. Our findings reveal a 67% increase in compliance costs since the enactment of GDPR, with a notable 45% of surveyed MNCs citing conflicting obligations between jurisdictions. This research underscores the urgent need for harmonization of data protection regulations to facilitate smoother international business operations and mitigate legal risks.
